NASCAR has accused a district court judge of making numerous errors leading to what the company claims is an incorrect decision in the suit.

The 23XI Racing and Front Row Motorsports antitrust lawsuit against NASCAR remains ongoing as the 2025 Cup Series season begins with this Sunday’s Daytona 500.

NASCAR, in an appeal filed roughly one hour before the start of Daytona 500 qualifying, argued that a federal judge erred in recognizing 23XI Motorsports and Front Row Motorsports as chartered teams for 2025.

U.S. District Judge Kenneth Bell of the Western District of North Carolina in December issued a preliminary injunction that allowed 23XI and Front Row to receive the same rewards as a chartered team while the lawsuit wades through the court system.

NASCAR has filed an appeal to a district court’s recent ruling that the two plaintiff Cup Series teams — 23XI Racing and Front Row Motorsports, who sued NASCAR on the grounds that it is a monopoly — should be allowed to continue competing with a charter during the 2025 season,

NASCAR released a statement regarding 23XI Racing's status this year, just ahead of the Daytona 500, the first race of the Cup Series season.
